An Air Hostess training school, Frankfinn, have filed an injunction in the Delhi High Court against the producers Dum Maaro Dum for trademark infringement.
The Delhi High Court has admitted the injunction application of Frankfinn and issued the notice to Mr. Ramesh Sippy and Fox Star Studio, the producers of the film, and others to be present in Delhi High Court on Thursday, 21st April, 2011.
Dum Maaro Dum is directed by Rohan Sippy and headlines Abhishek Bachchan, Kangana Ranaut, Bipasha Basu, Aditya Pancholi, Prateik Babbar and Rana Daggubati.
It will be released on Friday, April 22, in 20 countries at 350 international locations and at 1,000 theaters and multiplexes throughout India.
Earlier a petition had been filed in the Panaji bench of the Bombay High Court seeking a ban on the film for "objectionable portions."
The objection focused on a dialog mouthed by actress Bipasha Basu, "In Goa, liquor is cheap and women, cheaper."
On Monday the Panaji bench disposed off the petition after filmmakers agreed to delete the dialog from the film. The film's promos have been suitably modified with the word women replaced by relationships.
Frankfinn Institute of Air Hostess Training, who have filed the fresh lawsuit had earlier entered into a branding arrangement with Fox Star Studio India wherein Bipasha Basu was to be shown as as one of the Institute's student undergoing Air Hostess training.
Under the arrangement, Frankfinn agreed to the use of its Trade Marks, logos, images of Signage as well as students uniform in the film. However, the institute later retracted from the deal after realizing that the "film is not in line with high standards of education, training and ethics imparted by Frankfinn"
Following Frankfinn's withdrawal, Dum Maaro Dum producer used "a logo and image deceptively and remarkably similar to that of Frankfinn logos" triggering the lawsuit.
